TERMS AND CONDITIONS – Mini Family Portrait Photo Session – A3 Print Offer, Dec 2023.

 

 

DEFINITIONS

 

For the purpose of this agreement “the booking individual” shall be interpreted as references to “the client”. “Kieran Hunt” shall be interpreted as references to “the photographer”. “Photographs” means all photographic material furnished by the photographer, whether prints, digital files, or any other type of physical or electronic material.

 

COPYRIGHT

 

The entire copyright in the photographs (whether prints or digital files) is retained by the photographer at all times throughout the world.

 

OWNERSHIP OF MATERIALS

 

The client or any permitted persons who purchase physical prints or digital files (supplied via email) of the photographs becomes the owner/s of the physical print or printed digital file. The entire copyright in the photographs (prints or digital file supplied via email) is retained by the photographer at all times throughout the world.

 

USE

 

Even where any form of ‘all media’ licence is granted, the photographer’s permission must be obtained before any use of the photographs for other purposes e.g. use in relation to a product or sublicensing through a photo library. Permission to use the photographs for purposes outside the terms of Use will normally be granted upon a further contract and fee, which must be mutually agreed before such further use. Unless otherwise agreed in writing, all further Licences to Use in respect of the photographs will be subject to these terms and conditions.

 

CLIENT CONFIDENTIALITY

 

The photographer will process personal information lawfully, fairly, and transparently. The photographer will keep personal information confidential and will not disclose to any third parties or share, make use of material or information communicated for the purposes of the photography order, save as may be reasonably necessary to enable the photographer to carry out their obligation in relation to the order. Personal data is also processed in a manner to ensure security. The client can find out more about how the photographer uses their data from the photographer’s ‘Data Protection Policy’ (please see below).

 

ORDER CONFIRMATION AND PAYMENT

 

A photo session is considered firm as from the receipt of a completed booking form/slip. Payment by the client will be expected at the time of booking. Payment can be made by bank transfer.

 

REJECTION

 

There is no right to reject on the basis of photographic style or presentation (including, but not limited to, image composition, content, choice of focus, use of lighting, brightness, contrast, quantity of images captured).

 

PHOTOGRAPHIC SERVICE

 

Mini family portrait photo session: £30.00, includes complimentary A3 print. Photo sessions approximately 15 minutes in length. Additional prints and digital images available for purchase. Maximum of 6 individuals per photo session. Offer and bookings available until Monday 18th December 2023.

Whilst every care is taken to process the photo session the photographer cannot be held responsible for unforeseen circumstances beyond the photographer’s reasonable control, which may affect the quality or the completion of the session (including, but not limited to, weather conditions, sudden development of a fault in equipment, conflicting instructions from the client or persons present at the commission/event, acts of local or central Government or other competent authorities).

 

In terms of colour matching the photographer will provide a pleasing colour balance however cannot guarantee exact colour matching owing to anomalous reflections caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to photographically record the exact colour seen by the human eye. In terms of colour matching/reproduction of digital files the photographer cannot guarantee exact colour matching/reproduction between different electronic display and printing devices or photographic prints. This is due to potential different colour characteristics/representations/ capabilities for different electronic display and printing devices or photographic prints.

 

In regards to photographing in low light environments (including inside venues) the photographer sometimes will have to make equipment adjustments that will result in a graininess texture/quality to the images in order to capture the images. In such circumstances the client agrees to accept these affects.

 

Purchased/supplied prints and/or digital images are normally ready within 30 working days from the photo session. Purchased/supplied digital images would be suitable for printing up to approximately A4 size.

 

ORDERING – PRINT AND DIGITAL IMAGES

 

To order an image, the client will inform the photographer of the corresponding file number of the chosen images through a printed purchasing form. Photographic prints and digital files orders are normally ready within 30 working days from the photo session. However, orders received after the third week in November cannot be guaranteed in time for Christmas due to seasonal demand. Payment by the client will be expected at the time of order placement. Payment can be made by bank transfer. Small differences in colour/contrast of prints of the same image and different images can occur when they are made at different times due to variances in processing temperatures and chemicals etc. In terms of colour matching/reproduction of digital files the photographer cannot guarantee exact colour matching/reproduction between different electronic display and printing devices or photographic prints. This is due to potential different colour characteristics/representations/capabilities for different electronic display and printing devices or photographic prints.

 

CANCELLATION & POSTPONEMENT

 

A photo session is considered firm as from the receipt of a completed booking form/slip. The photographer may cancel the booking at anytime without liability to the client if a) the photographer is unable to operate for any reason beyond their control, b) the client associated with the order and/or the purpose of the commission/event might damage the reputation of the photographer, c) the client has failed to provide all details of the booking to the photographer.

ELECTRONIC STORAGE

 

The photographs may not be stored in any form of electronic medium without the written permission of the photographer unless the client has purchased digital files of the images. Manipulation of commission images may only take place with the permission of the photographer.

 

APPLICABLE LAW

 

This agreement shall be governed by the laws of England and Wales.

 ​

These Terms and Conditions shall not be varied except by agreement in writing.
